1. Introduction

These Terms and Conditions (T&C) apply to the use of our webshop at www.trisphere.nl and to all orders and purchases of cosmetic raw materials and related products made through the website. By using our website or placing an order, you acknowledge that you have read, understood, and agree to be bound by these T&C.

2. Applicability

2.1 These T&C apply to every offer, quotation, and agreement between Trisphere and any natural or legal person (“you”, “the customer”, “the buyer”).
2.2 Deviations from these T&C are only valid if expressly agreed upon in writing.

3. Products and Intended Use

3.1 Our products are supplied for cosmetic formulation by DIY enthusiasts, as well as for research and manufacturing purposes.
3.2 They are not intended for direct consumer use. Trisphere is not responsible for any damage, mishandling, or improper use of the supplied materials.
3.3 It is your responsibility to ensure compliance with all applicable national and EU laws and regulations.
3.4 We make no guarantees regarding the suitability of any product for a specific formulation or purpose.

4. Prices and Payment

4.1 All prices are stated in euros (€), including VAT unless otherwise indicated.
4.2 We reserve the right to adjust prices and shipping costs at any time.
4.3 Payment must be made in full at the time of ordering, through the payment methods offered on the website.
4.4 Orders will only be processed once payment has been received and confirmed.

5. Shipping and Delivery

5.1 We deliver within the Netherlands (excluding overseas territories) and throughout the EU. Customers in Greece, Malta, and Cyprus should contact us to determine the most suitable shipping method.
5.2 Delivery times depend on the destination country. We are not liable for any delays beyond our control.
5.3 The company retains all risk of loss or damage to the products until the products are successfully delivered to your designated delivery address and accepted by you..
5.4 Any import duties, customs fees, or local taxes, where applicable, are the responsibility of the buyer.

6. Withdrawal and Return Policy

6.1 Due to the nature of our Products (raw materials and chemicals), the right of withdrawal under Article 6:230p sub d of the Dutch Civil Code does not apply.
6.2 Returns are only accepted in cases of incorrect delivery or defective Products.
6.3 Claims must be submitted within 7 days of receipt, including your order number and supporting photos.
6.4 If a claim is accepted, we will offer a refund or replacement at our discretion.

7. Liability

7.1 We are not liable for any damage resulting from improper use of our products or non-compliance with applicable laws or regulations by the buyer.
7.2 Our total liability is limited to the invoice value of the relevant product.
7.3 We are not liable for indirect damages, including consequential loss, loss of profit, or reputational damage.

8. Intellectual Property

All content on this website, including text, images, logos, product descriptions, and data, is the intellectual property of Trisphere or its licensors.
No part of the website may be copied, distributed, or used without our prior written consent.

9. Force Majeure

We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to: strikes, fire, flooding, transport issues, supply chain disruptions, or government restrictions.

11. Governing Law and Jurisdiction

11.1 These Terms are governed exclusively by Dutch law.
11.2 Any disputes arising from or related to these T&C shall be submitted to the competent court in Lelystad, The Netherlands, unless mandatory law provides otherwise.

We may amend these T&C from time to time. The latest version will always be available on our website. Continued use of our website after such changes constitutes acceptance of the new T&C.
